Refund & Cancellation Policy

1. Introduction


At Hertzsoft Educare (part of Hertzsoft Technologies Pvt. Ltd., your Mumbai-based tech training hub), this Refund & Cancellation Policy ("Policy") covers refunds and cancellations for our offline classroom courses, website (educare.hertzsoft.com), Student Portal, and Mobile App. All courses run in-person at our Dongri office (Office No. 105, 1st Floor, A-Wing, Al-Ameen Tower, Jail Road (South), Dongri, Mumbai - 400009). Payments are offline only via UPI, NEFT, Cash, Cheque, or Demand Draft (DD) in INR.

By enrolling or using our Services (Student Portal/App for attendance, fees, notifications), you agree to this Policy. It follows Indian Contract Act, 1872, Consumer Protection Act, 2019, and DPDP Act, 2023. No refunds if you ghost classes or misuse Services. Straight up: Pay smart, attend hard.


2. Eligibility for Refunds & Cancellations

Refunds apply only to course fees (not materials or admin charges). You qualify if:

  • ● Cancellation before course start (full/partial based on timeline).
  • ● Valid reason like medical proof (doctor note required for Mumbai locals).
  • ● No eligibility post-20% attendance or after 50% course completion - that's on you.

Portal/App subscriptions (if any premium features) follow same rules; free access has no refunds. All requests via email or office visit.


3. Refund Process & Timelines

Full advance fee in INR required upfront. Refunds processed within 7-10 business days via original mode (e.g., NEFT reversal). Bank details needed for electronic refunds; cash/cheque returns at office only.

Refund Scenarios:

  • Pre-Course Start: 100% refund within 7 days of payment (minus ₹500 admin fee for processing).
  • After Course Start: 50% refund within first 3 days (if <10% attendance); 0% after that or if you dipped out voluntarily.
  • Portal/App Access: Full refund within 7 days of activation if unused; partial (50%) within 14 days for minor use. No refunds for notifications or records viewed.

Admin fee covers paperwork - non-negotiable. Taxes (GST if applicable) non-refundable.


4. Cancellations by Us

If we cancel (e.g., Low Enrollment, Trainer Issue, or Lockdown Imposed), full 100% refund + ₹200 transport reimbursement for Mumbai locals (receipt must). We'll notify via SMS/Email/Portal at least 48 hours prior. No liability for your missed opportunities - we reschedule if possible.


5. Non-Refundable Items

Non-refundable:

  • ● Course materials (notes, certificates) once issued.
  • ● Admin/processing fees (₹500+).
  • ● Transfers to other courses (₹1,000 extra fee).
  • ● Portal/App data exports or custom notifications.
  • ● Late payments or bounced cheques (₹200 penalty).

Violations (e.g., disruptive in class or hacking Portal) = immediate termination, zero refund.


6. Disputes & Governing Law

Disputes? Talk first – email or visit office. If no fix, Mumbai courts only (Maharashtra jurisdiction). Governed by Indian laws; arbitration under Arbitration & Conciliation Act, 1996 if needed (Mumbai venue).
