1. Introduction

Welcome to Hertzsoft Educare (operating as part of Hertzsoft Technologies Pvt. Ltd., a Mumbai-based technical training institute). These Terms & Conditions ("Terms") govern your use of our offline classroom-based courses, website (educare.hertzsoft.com), and any digital services like the Student Portal and Mobile App (collectively, "Services"). All courses are conducted in-person at our Mumbai facility (Office No. 105, 1st Floor, A-Wing, Al-Ameen Tower, Jail Road (South), Dongri, Mumbai - 400009). We do not offer online courses.

By submitting an enquiry, enrolling in a course, or using our Services (including Student Portal/App for attendance, fee records, and lecture notifications), you agree to these Terms. If you do not agree, do not use our Services. These Terms comply with the Indian Contract Act, 1872, Information Technology Act, 2000 (as amended), Digital Personal Data Protection Act, 2023 (DPDP Act), and other applicable Indian laws.

2. Use of Our Services

You may use our Services only for lawful purposes related to technical education. Prohibited activities include:

• ● Harassment, fraud, or unauthorized access to others' data (e.g., via Student Portal/App).
• ● Commercial use without permission (e.g., reselling course notes).
• ● Disrupting classes or Services (e.g., no recordings of offline sessions).
• ● Violating Indian laws, including IT Act Section 66 (hacking) or DPDP Act data misuse.

Student Portal and Mobile App will allow access to personal records (attendance, fees, notifications) via secure login. Misuse (e.g., sharing credentials) may result in suspension. All data handling follows our Privacy Policy.

3. Registration & Enrollment

Enquiries via website require Name, Email, and Phone. Full enrollment via offline Admission Form at our Dongri office, collecting Name, Gender, Qualification, Email, Phone, Photograph, College/Company, DOB, Course Name, Address, and Reference. By submitting, you confirm accuracy and eligibility (18+ years or parental consent).

No online accounts; Student Portal/App access via email OTP. We reserve rights to reject/terminate enrollment for policy violations. Confidentiality of your data is maintained per Privacy Policy.

4. Payments & Refund Policy

All fees are in INR and collected offline at our Mumbai office via UPI, NEFT, Cash, Cheque, or Demand Draft (DD). Full advance payment required before course start. No online payments or third-party gateways.

Refund Policy:

• ● Pre-Course Start: 100% refund within 7 days of payment (minus ₹500 admin fee).
• ● After Course Start: 50% refund within first 3 days.
• ● Cancellations by Us: Full refund + reimbursement for local Mumbai transport (receipt required) if due to unforeseen events (e.g., low enrollment).
• ● Disputes: Resolved per Indian Contract Act; no refunds for voluntary withdrawal post-50% course.

Fees non-transferable to other courses without admin approval (₹1,000 fee). Student Portal/App fee views are for records only; disputes handled via office visit or email at educare@hertzsoft.com

5. Intellectual Property

All course materials, notes, slides, and Student Portal/App content (e.g., lecture notifications) are owned by Hertzsoft Educare. You get limited license for personal offline use; no reproduction, distribution, or commercial exploitation without written consent.

Violations (e.g., sharing Python code samples online) may lead to termination and legal action under Copyright Act, 1957. Student photos/names used promotionally with consent (per Privacy Policy).

6. Limitation of Liability

We provide Services "as is" without warranties. Not liable for indirect damages (e.g., lost job opportunities) or disruptions (e.g., Mumbai traffic affecting classes). Total liability capped at course fees paid.

For Student Portal/App: Not liable for downtime, data errors, or device issues. No guarantees on job placements (efforts only, ~80% success rate based on past Mumbai batches). Complies with Consumer Protection Act, 2019.

7. Termination of Services

We may suspend/terminate access for violations (e.g., disruptive behavior in classes or Portal misuse) without refund. You may withdraw anytime, subject to refund policy. Upon termination, data access ends per Privacy Policy retention rules.

8. Updates to These Terms

We may update Terms for new Services (e.g., Portal/App launch) or laws. Notice via email, website, or SMS (15 days advance). Continued use implies consent.

9. Governing Law & Dispute Resolution

These Terms governed by laws of India. Exclusive jurisdiction of courts in Mumbai, Maharashtra. Disputes resolved amicably first; if not, via arbitration under Arbitration & Conciliation Act, 1996 (Mumbai venue).
